ORDER
This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ), seeking prearrest bail.
2. The applicant is the sole accused in Crime No.34/2026 of Valancheri Police Station, Malappuram District. The offences alleged are punishable under Sections 126 (2) and 75(1)(i) of the Bharatiya Nyaya Sanhita, 2023 .
3. The prosecution case, in short, is that on 10.01.2026 at about 5:00 p.m. at the Vishal Mega Mart in Valencheri, where the defacto complainant is working as a customer care staff, the applicant pulled her close, hugged her, caught hold of her breast, attempted to kiss her, outraged her modesty and thereby committed the aforementioned offences.
4. I have heard Sri.P.Vijayabhanu, the learned senior counsel for the applicant and Sri.K.A.Noushad, the learned Senior Public Prosecutor. Perused the case diary.
5. The learned senior counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the above crime.
