ORDER
This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short, BNSS ), seeking pre-arrest bail.
2. The applicant is the accused No.7 in Crime No.146/2025 of Cyber Crime Police Station, Thiruvananthapuram District. The offences alleged are punishable under Sections 318(4) and 319(2) read with Section 3 (5) of the Bharatiya Nyaya Sanhita , 2023 and Section 66D of the Information Technology Act , 2000.
3. The prosecution case, in short, is that accused persons in furtherance of their common intention to obtain wrongful gain and to cause wrongful loss to the defacto complainant, made him believe that if he join in the online trading business, he would get more profit and thereafter obtained a total sum of ₹37,21,955/- from him through 11 transactions to the bank account of the accused Nos.1 to 11. Thereafter, the accused did not return the said amount to the defacto complainant and thereby committed the offences.
