Dated 17th day of February 2026 JUDGMENT The petitioner availed a secured vehicle loan from the respondents by hypothecating his vehicle (Eicher Pro 2080XPT D CBC, bearing Registration No. KL-19-N-1616). Subsequently, the petitioner committed default in repayment of the loan amount. On account of the said default, the respondent Bank initiated proceedings under the provisions of the SARFAESI Act . Aggrieved by the said proceedings, the petitioner has approached this Court by filing the present writ petition.
2. Ext.P3 is the representation submitted by the petitioner before the respondent Bank seeking permission to settle the outstanding liability under a One Time Settlement scheme.
3. It is submitted that the physical possession of the vehicle has already been taken by the respondent Bank. This Court, by order dated
10.02.2026, had directed that the vehicle shall not be sold.
