Court reinforces administrative compliance in municipal regulations for public space management and enforcement.

JUDGMENT

The above Writ Petition (C) is filed with the following prayers:

" i. Issue a writ of mandamus or any other appropriate writ, order or direction commanding the Respondents to forthwith take effective and continuous measures to abate, prevent, and remove the illegal, unauthorized, and indiscriminate parking of vehicles in front of the Petitioner’s building, including on the southern road margin of Subhash Chandra Bose Road and the abutting footpath;

ii. Issue a writ of mandamus or any other appropriate writ, order or direction directing Respondents 1 to 4 to immediately erect and maintain a clearly visible “NO PARKING” signboard on the southern margin of Subhash Chandra Bose Road in front of the Petitioner’s building and to enforce the same strictly so as to prevent further obstruction;

iii. Pass such other and further orders that this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice. "

2. The petitioner’s grievance is that there is unauthorised parking of vehicle in front of the petitioner’s building and "NO PARKING” sign board is also not erected in that place, and therefore, the unauthorised parking is continuing. Hence, this writ petition.

3. Heard the learned counsel for the petitioner, the learned Government Pleader and also the learned Standing Counsel appearing for the Corporation.

4. When this writ petition came up for consideration before this Court on 04.02.2026, this Court passed the following order:

“The competent authority among respondents 3 and 4 will see that the ingress and egress to the petitioner's building is not obstructed by parking autorickshaws, taxis etc.

Post on 19.02.2026. “

5. The learned counsel for the petitioner submitted that the above order is not complied even now. The 3^rd and 4^th respondents will see that the above order is complied in letter and spirit forthwith. The second prayer of the petitioner is to erect a “NO PARKING” board in front of the petitioner’s premises to avoid unauthorised parking. For that purpose, the petitioner can approach the Corporation authorities with appropriate application. If such an application is filed, the 7th respondent can consider the same and do the needful in accordance with the law.

Therefore, this writ petition is disposed of with the following directions:

i) The order dated 04.02.2026 is made absolute.

ii) The competent authority among respondents 3 and 4 will see that the above order is complied with in letter and spirit.

iii) The petitioner is free to submit appropriate application before the competent authority among respondents 6 and 7 for erecting a “NO PARKING” sign board in front of the petitioner’s premises, and if such an application is filed, the competent authority will do the needful in accordance with the law, as expeditiously as possible, at any rate, within a period of three weeks from the date of receipt of the application.

iv) The petitioner will produce a certified copy of this judgment along with a copy of this writ petition with Exhibits before the respondents for compliance.
