Courts must ensure timely resolution of civil suits while maintaining prior order statuses untrammeled by earlier judicial observations.

Headnote:This judgment arises from OP

(C) No. 505 of 2023, where the petitioner challenges a concurrent finding regarding an injunction application. The court has directed the Munsiff Court, Punalur to expedite the resolution of O.S. No. 339/2021 without influence from earlier orders. The court maintained status quo till final resolution of the suit. The findings ensure timely legal proceedings while respecting due process.

JUDGMENT

The above Original Petition is filed challenging the concurrent finding by the trial court and the appellate court in an injunction application.

2. This Court perused the impugned orders. I don’t want to make any observation about the same. This Original Petition is pending before this Court from 2023 onwards. The suit was filed in the year 2021. Without making any observation about the impugned orders, I think, there can be a direction to the court below to dispose of the suit itself within a time frame, untrammelled by any observation in the impugned orders. When this original petition came up for consideration, there was an order of status quo. I think that status quo order can continue till the suit is finally disposed of.

Therefore, this Original Petition(C) is disposed of with the following directions:

1. The Munsiff Court, Punalur is directed to dispose of O.S. No.339/2021, as expeditiously as possible, at any rate, within a period of four months from the date of receipt of a certified copy of this judgment.
