The dismissal of a criminal miscellaneous case becomes appropriate when the investigation is complete and a final report has been submitted, allowing the petitioner to re-challenge the report.

Headnote:The petitioner filed a Crl.M.C under Section 482 of the Cr.P.C. to quash proceedings against the 2nd respondent. The Public Prosecutor informed that police had completed the investigation and filed the Final Report. The Court determined the case to be infructuous and dismissed the application, allowing the petitioner to challenge the Final Report.

ORDER

Dated this the 20th day of February, 2026 The defacto complainant in Crime No.833 of 2019 of Pathanapuram Police Station, filed this Crl.M.C under Section 482 of the Cr.P.C, praying for quashing all further proceedings against the 2nd respondent/the accused.

2. The learned Public Prosecutor upon instructions submitted that, in this case, the Police already completed the investigation and filed Final Report on 10.02.2026, before the First Additional Sessions Court, Kollam.

In the above circumstances, this Criminal Miscellaneous Case became infructuous and accordingly, it is dismissed as infructuous, with liberty to the petitioner to challenge the Final Report.
