ORDER

The Criminal Miscellaneous Case is filed to issue necessary directions to the Court of the Judicial First Class Magistrate-I, Pathanamthitta, to accept the fine amount imposed on the petitioner pursuant to the judgment dated 16.12.2015 in Crl.R.P. No. 1702/2015 and to refrain them from executing the default sentence imposed on the petitioner.

2.When the Crl.M.C came up for consideration on

22.01.2026, this Court found that the prayer sought for in the application is not maintainable in view of the law laid down by this Court in Sreedharan v. Bharathan ( 2014 (1) KLT 236 ). Nonetheless, this Court permitted the petitioner to move an application in Crl.R.P. No. 1702/2015 to extend the time period to deposit the fine amount.

3. In light of the above order, I am of the view that nothing further survives in the Crl.M.C.

In the result, the Crl.M.C is dismissed, but without prejudice to the right of the petitioner to file an application for enlargement of time as observed in the order dated 22.01.2026.
