The availability of alternate remedies prior to seeking judicial intervention in transport permit matters.

JUDGMENT The petitioner challenges Ext.P1, the order through which an application for a regular permit was rejected. The petitioner has an adequate and effective alternate remedy available before the State Transport Appellate Tribunal.

Taking note of the principles laid down by this Court in Bus Operators Organisation, Palakkad v. Regional Transport Officer, Palakkad ( 2026 KHC Online 117 ), I am not inclined to entertain this writ petition and the same is accordingly closed, without prejudice to the right of the petitioner to approach the Tribunal challenging the application. If the petitioner prefers an appeal within two weeks from today, the same shall be considered on merits, and appropriate orders shall be passed. All the contentions of the petitioner are left open. The petitioner may also approach the transport authority if the petitioner is willing to accept the reasons stated in the order and is prepared to cure the alleged defects.
