IN THE HIGH COURT OF KERALA AT ERNAKULAM
T.R.RAVI, J
LALITHA S – Appellant
Versus
ABDUL KAREEM (DECEASED) LRs IMPLEADED – Respondent

Advocates:
For the Appellants/Petitioners: SRI.SAJAN VARGHEESE K., SRI.LIJU. M.P
For the Respondents: SRI.RAJESH SIVARAMANKUTTY, SMT.VIJINA K., SRI.ARUL MURALIDHARAN

JUDGMENT

Petitioners have challenged Ext.P14 whereby an application for impleading the legal representatives of the 6th defendant is dismissed. The Court found that the 6th defendant had already transferred the property to a stranger pending the litigation and as such the legal representatives are not required to be impleaded since they have not succeeded to any right regarding the property from the 6th defendant. The order does not suffer any legal infirmity. Unless the right to sue survives on the legal representatives, there is no necessity to implead them.

The original petition fails and is dismissed. This is without prejudice to the right, if any, of the petitioners against the transferees of the 6th defendant.
