IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
NISSAMUDHEEN K V – Appellant
Versus
SPECIAL SALE OFFICER VATTAMKULAM PANCHAYATH SERVICE CO-OPERATIVE BANK LTD. – Respondent
JUDGMENT The writ petition is filed with the following prayers;
“(i) Issue a writ of mandamus or any other appropriate writ, order or direction directing the respondent bank to allow installment facilities to clear the entire liability within the period of two years;
(ii) Considering the exigencies and necessity of urgent consideration of the grievance voiced in this writ petition, production of English translations of documents in vernacular, may kindly be dispensed with for the time being.”
2. It is seen that the writ petition was filed without impleading the Bank, which initiated the recovery proceedings against the petitioner for non-payment of the dues.
3. It is submitted on behalf of the Vattamkulam Panchayath Service Co-Operative Bank that the auction had taken place on
17.02.2026, which is not disclosed in the writ petition.
Given the above, I am not inclined to grant any relief to the petitioner and the same is accordingly dismissed.
