O R D E R
This is the fourth bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ) seeking regular bail.
2. The applicant is the accused No.1 in Crime No.1152/2024 of Valappad Police Station, Thrissur District. The offences alleged are punishable under Sections 281 , 125(a), 125(b) and 105 r/w Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that on
26.11.2024 at 03:35 am., the applicant drove the lorry involved in an intoxicated stage, and in a rash and negligent manner towards the bypass road in front of the J.K.Cinema Theatre at Nattika, where around 15 persons were sleeping. The applicant destroyed the divider fixed in connection with the construction of the road and dashed against those persons sleeping on the side of the road. Five persons died and another five persons sustained severe injuries in the accident and thereby committed the offences. The applicant was remanded to judicial custody on 26.11.2024.
