JUDGMENT

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

2. The petitioner is the mother of accused No.9 in S.C.No.698/2019 on the file of the Additional Sessions Court, Ottappalam. He is a life convict lodged in Central Prison and Correctional Home, Thavanoor. He was granted ordinary leave as per Ext.P2. The conditions in Ext.P2 are that he shall not enter the territorial limits of Ottappalam Police Station and that he shall reside outside the jurisdiction of Ottappalam Police Station.

3. The learned counsel for the petitioner submitted that the convict’s house is situated within the territorial limits of Ottappalam Police Station. Therefore, these conditions prevent the convict from enjoying the fruits of Ext.P2. It is further submitted that the said conditions will defeat the very purpose of the ordinary leave granted to the convict. Therefore, the conditions in Ext. P2 to the effect that the petitioner’s son shall not enter the territorial limits of the Ottappalam Police Station in Palakkad District stand deleted.

The Writ Petition stands allowed.
