The Court has the authority to direct the speed of trial proceedings under Article 227 of the Constitution.

JUDGMENT

The Prayers in this Original Petition filed under Article 227 of the Constitution of India are as follows:-

” 1. To direct the Hon’ble Judicial First Class Magistrate Court, Angamaly to conduct a speedy trial and early disposal within a time limit fixed by this Hon’ble Court in CC No. 817/2018 in crime no. 702/2015 of Nedumabassery Airport Police Station, Ernakulam District, in the interest of justice.

2. Pass such other order which this Hon’ble Court may deem fit and proper, considering the peculiar facts and circumstances of the case in the interest of justice. ”

2. On 06.02.2026, this Court directed the Registry to obtain a report from the Court concerned on the time required for the disposal of the matter.

3. A report has been obtained from the Judicial First Class Magistrate Court, Angamaly, stating that the matter could be disposed of within a period of six months. Therefore, the Judicial First Class Magistrate Court, Angamaly, is directed to dispose of C.C. No.817 of 2018 within a period of six months from the date of production of a certified copy of this judgment. The Trial Court is at liberty to seek extension of time, if necessary.

The Original Petition is disposed of as above.
