After arguing the case at length, the learned counsel for the appellant seeks permission to withdraw the appeal as well as writ petition with liberty to challenge Exhibit P6 Government Order issued by the second respondent as also the provisos to Rule 115(2) of the Central Motor Vehicle Rules , 1989. The submission of the learned counsel for the appellant is placed on record.

Accordingly, the appeal as well as the writ petition is dismissed as withdrawn granting the liberty as prayed for.
