JUDGMENT
The writ petition is filed with the following prayers:-
1. Issue a writ of mandamus of other appropriate writ order or direction commanding the respondents to consider Ext.P2 application submitted renewal of permit on the route Kumaly – Chottanikkara and grant and issue the same in the interest of justice.
2. Issue appropriate writ, order or direction to the 2nd respondent to consider Ext.P3 application for replacement of vehicle submitted by the petitioner so as to operate service on the route Kumaly – Chottanikkara as LSOS with the incoming vehicle and grant the same.
3. Issue appropriate writ, order or direction to the 2nd respondent to consider Ext.P4 application for temporary permit in respect of stage carriage No. KL 06/L 7839 on the route Kumaly – Chottanikkara as LSOS and grant and issue the same without any delay.
4. Grant the petitioner such other reliefs which this Hon’ble court deem just and fit in the circumstance of the case.
2. The learned Government Pleader, on instructions, submits that the petitioner is a saved permit holder and that the KSRTC will also have to be heard before orders are passed on his application. This is recorded.
Accordingly, there will be a direction to the 1st respondent - Authority to consider and pass orders on Ext.P2 application for renewal within one month from the date of receipt of a copy of this judgment. Based on the orders to be passed on the renewal application, the competent Authority shall consider the application for replacement of the vehicle submitted by the petitioner.
In the meantime, there will be a direction to the 2nd respondent to consider Ext.P4 application for a temporary permit in accordance with law, within three weeks from the date of receipt of a copy of this judgment.
The Writ petition is disposed of as above.
