IN THE HIGH COURT OF KERALA AT ERNAKULAM
BECHU KURIAN THOMAS, J
COMMUNIST MARXIST PARTY (KERALA STATE COMMITTEE) – Appellant
Versus
ELECTION COMMISSION OF INDIA – Respondent
JUDGMENT
The petitioner is a political party registered under Section
29A of the Representation of Peoples Act, 1951 . The grievance of the petitioner is that, despite filing a representation as Ext.P2, seeking relaxation of the conditions in Paragraph 10B of the Election Symbols Reservation and Allotment Order, 1968, no orders have been passed by the said authority, till date. 2. The learned counsel for the petitioner submitted that the hearing had concluded as early as in December 2025 and till date no orders have been passed.
3. I have heard the learned counsel for the petitioner as well as the learned Standing Counsel for respondents 1 to 3.
4. Having heard the respective counsel, I am of the view that the writ petition can be disposed of by directing the 1st respondent to consider and pass appropriate orders on Ext.P2 in a time bound manner.
Accordingly, there will be a direction to the 1st respondent to consider and pass appropriate orders on Ext.P2 as expeditiously as possible, at any rate, within a period of three weeks from the date of receipt of a copy of this judgment.
