A writ petition becomes infructuous once a final voters list has been published, rendering any challenge to the draft list moot.

JUDGMENT

This writ petition was filed seeking the following reliefs:

“i. To set aside Ext.P1 Draft Voters list and accompanying publication dated 27/04/2024 and stay the election of Edavazhikkal Kayal Padasekhara Nellulpadaka Samithi Reg.No.A230/2011, Nehry Trophy Ward, Avalookkunnu P.O., Alappuzha proposed to be held on

16.05.2024 ii. To direct the 2^nd and 3^rd respondents to consider and take appropriate action on Ext.P2 complaint and publish draft voters list afresh before conducting Election of Edavazhikkal Kayal Padasekhara Nellulpadaka Samithi Reg.No.A230/2011, Nehry Trophy Ward, Avalookkunnu P.O., Alappuzha iii. To direct the respondents 2 and 3 to elect a panel of members from the General Body of Edavashikkal Kayal Padasekhara Nellulpadaka Samithi Reg.No.A230/2011, Nehry Trophy Ward, Avalookkunnu P.O., Alappuzha to verify the last 3 years accounts of the Nellulpadaka Samithi.”

The learned Government Pleader has filed a memo producing a copy of the order dated 31.05.2025, stating that the complaint filed by the petitioner and 46 others seeking the draft voters list for the general election to the Padashekhara Samithi was rejected, and the voters list published on 04.05.2024 has been declared to be final.

3. Since the challenge in the writ petition relates to the draft voters list and by the order aforementioned, the objections of the petitioner and others have been rejected, and a final list has already been published, this writ petition has become infructuous.

Accordingly, this writ petition is dismissed as infructuous reserving the liberty of the petitioner to initiate appropriate proceedings, if aggrieved by the aforementioned order in accordance with law.
