JUDGMENT
This writ petition is filed seeking the following prayers:
i) Issue a writ of mandamus or any other appropriate writ, order or direction, directing the 2nd respondent to immediately implement necessary measures for the renovation and proper functioning of the slaughterhouse, including the activation of all installed modern machinery and waste treatment systems.
ii) The 2nd respondent be directed to secure all requisite clearances and permissions without further delay.
iii) Completion of construction for a modern slaughterhouse within a stipulated time.
iv) Dispense with the filing of vernacular documents.
v) Issue such other writ, direction or order that this Hon’ble Court may deem fit, just and necessary in the facts and circumstances of the case.”

The main prayer in this writ petition is to issue a direction to the 2nd respondent to immediately implement necessary measures for the renovation and proper functioning of the slaughterhouse, including the activation of all installed modern machinery and waste treatment systems. A counter affidavit is filed by the 2nd and 3rd respondent. The relevant portion is extracted hereunder;
“6. It is respectfully submitted that the renovation of modernised slaughterhouse of Tirur Municipality as per the Detailed Project Report for an amount of Rs.2,16,52,000-00 prepared by the agency namely 'Centre for Farming and Food Processing’ is undergoing. The mechanical, civil and electrical work in the slaughterhouse is in its final stage. It is also submitted that as per the order bearing No.2117/A/2020/SM dated 04-10-2023 by the Executive Director, Suchitwa Mission, Technical sanction was granted for installation of Effluent Treatment Plant for an amount of Rs.83,30,000-00. The said work was put to tender and work was allotted to a firm namely 'S.A Engineering'. Thereafter Municipality has entered into contract with 'S.A Engineering' and work is in progress. Moreover, in order to complete final civil work, project was allocated and estimate was prepared and administrative sanction was approved. Though the said work was put to tender in twice and invited quotation three times, nobody came forward to execute the work. Hence, final civil work could not be completed.
7. It is submitted that with regard to the modernised slaughterhouse of the municipality, the detailed project report was prepared for the installation of biogas plant. Since, municipality found anomalies in the detailed project report, municipality has directed the agency who prepared project report, to cure such defects.
8. It is pertinent to note that whenever the contractor who is entrusted with work of installation of Effluent Treatment Plant, neighbouring people are not allowing the contractor and technical department staffs of the Municipality to enter into the premise of slaughterhouse and to do further work. Despite constant discussions with neighbouring residents by the municipal council and officials. nothing has come of it. They are frequently protesting with a stand that further construction will not be allowed at the slaughterhouse and slaughterhouse should be relocated. In order to overcome such situation, the municipal council discussed the matter and decided to seek police assistance to complete the remaining work. The true copy of decision No.5/1 of municipal council dated 30-06-2025 is produced herewith and marked as Exhibit R2(a)
9. It is submitted that at present, the work of installation of machinery and electrification is already completed. The work with respect to Effluent Treatment Plant, Biogas plant and final civil works are pending. The modernised slaughter house can be commissioned after completing aforesaid works and getting clearance from the 4th respondent.”
