IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
YAHYA P. – Appellant
Versus
THE REGIONAL TRANSPORT AUTHORITY, KOZHIKODE – Respondent
JUDGMENT
The petitioner challenges Ext.P3 order passed by the State Transport Appellate Tribunal in M.V.A.R.P.No.30 of 2021. The said revision was filed by the third respondent herein against the settlement of timings in favour of the stage carriages of respondents 4 to 6.
2. The Tribunal, by judgment dated 28.09.2024, directed the Secretary, Regional Transport Authority, Kozhikode, to reconsider the issue and pass orders in accordance with law, within two months. It is seen from Ext.P3 order that nothing has been decided against the petitioner. All that is done as per Ext.P3 is a reconsideration.
3. Under such circumstances, the petitioner cannot be said to be aggrieved by Ext.P3 order. Accordingly, there will be a direction to the second respondent to implement Ext.P3 judgment of the Tribunal with notice to the petitioner and respondents 3 to 6. It will be open to the petitioner to produce such materials to substantiate his contentions, which will be adverted to while passing orders, as directed by the Tribunal.
The writ petition is disposed of as above.
