IN THE HIGH COURT OF KERALA AT ERNAKULAM
G.GIRISH, J
RIXON.K.E – Appellant
Versus
STATE OF KERALA – Respondent
ORDER
The accused in SC No.827/2019 on the files of the Additional Sessions Court (POCSO), Ernakulam, has filed this petition under Section 482 Cr.P.C, for quashing the proceedings in the aforesaid case.
2. It is submitted by the learned counsel for the petitioner that the petitioner had already been convicted by the Trial Court in the aforesaid case and the matter is now pending consideration in appeal before another Bench of this Court. Since the Trial Court has already disposed of SC No.827/2019, and the petitioner had taken up the matter in appeal, the relief sought for by the petitioner for quashing the proceedings in SC No.827/2019 on the files of the Additional Sessions Court (POCSO), Ernakulam, has lost its significance.
In the above circumstances, there is no purpose remaining to be fulfilled by the continuance of this Crl.M.C. The petitioner could very well seek appropriate reliefs against the conviction and sentence awarded by the Trial Court, in the appeal which he has filed against the aforesaid verdict.
For the above reasons, the Crl.M.C stands closed.
