MOHAMMED NIAS C.P., J
MALATHI – Appellant
Versus
VISHNU T.S. – Respondent
J U D G M E N T
The petitioner challenges Ext.P5 order passed by the Motor Accidents Claims Tribunal, Kollam, rejecting I. A No.10 of 2024 in O.P(M.V) No.757 of 2021. The said application was filed to reopen the evidence and to examine the Doctor, the Motor Vehicle Inspector and the Inspector of Police.
2. Having gone through the petitions, I find that no reason whatsoever stated for seeking re-opening of the evidence. The Tribunal rightly found that there was no reason stated in the application for seeking a re-opening of the evidence. The order of the Tribunal cannot be faulted with.
3. Given the above, the original petition fails and is accordingly dismissed. The dismissal of this original petition will not prevent the petitioner from filing an appropriate application, which shall be considered on its merits.
5. Taking note of the fact that the claim petition is of the year 2021, there will be a further direction to the Tribunal to pass final orders in O.P(M.V) No.757 of 2021 within two months from the date of receipt of a copy of this judgment.
