ORDER

Dated this the 23rd day of February, 2026 The accused persons 3 and 4 in C.C. No. 125 of 2023 on the file of the Judicial First Class Magistrate Court-II (Mobile), Kottayam, arising out of Crime No. 1721 of 2022 of Gandhi Nagar police station, have filed this Crl.M.C. under Section 528 of the B.N.S.S. praying for quashing all further proceedings against them. The offences alleged against the petitioner and other accused persons are under Sections 498A and 354 of the IPC .

2. The prosecution case is that the 1st accused, being the husband of the defacto complainant along with other accused persons, who are his relatives subjected the defacto complainant to cruelty both physically and mentally on the ground of dowry. It is also alleged that the

2nd accused outraged the modesty of the defacto complainant.

3. According the learned counsel for the petitioners, there are no specific allegations of cruelty and as such according to the learned counsel the proceedings against the petitioners are liable to be quashed.

4. The petition was opposed by the learned Public Prosecutor.

5. Though notice was served on the 3rd respondent/

defacto complainant, she did not turn up.
