JUDGMENT The petitioners are indebted to the respondent Bank on account of credit facilities availed by them. On default being committed, the Bank initiated proceedings under Section 69 of the Kerala Co-operative Societies Act , 1969 and obtained an award determining the liability of the petitioners. On the award being put to execution, the petitioners are before this Court seeking the following reliefs:-
I. Issue a writ of certiorari or any other appropriate writ, order or direction, quashing the operation and all further proceedings pursuance to Ext-P1 notice dated 22-12-2025 of the 2nd respondent forthwith;
II. Issue a writ of mandamus or any other appropriate writ, order or direction commanding the 1st respondent to provide 26 equal monthly installment against the arrears of the loan to regularize the loan account.
2. The learned counsel appearing for the respondent Bank submits that sale of the mortgaged property was held on 29.01.2026 and the Bank itself purchased the property in auction. It is submitted that notwithstanding the above, the Bank has no objection in some instalments being granted to the petitioners to clear the liability as the sale has not been confirmed. It i
