IN THE HIGH COURT OF KERALA AT ERNAKULAM
GOPINATH P., J
RAJEEVAN – Appellant
Versus
KOYILANDY CO-OPERATIVE AGRICULTURAL AND RURAL DEVELOPMENT BANK LTD. NO.D.2020 PERAMBRA BRANCH, KOZHIKODE – Respondent
JUDGMENT
This is the second round of litigation at the instance of the petitioner. The earlier writ petition, W.P(C) No.11248 of 2025, filed by the petitioner, was disposed of on 20-05-2025, permitting the petitioner to pay off the liability with the 1st respondent bank in 24 equal monthly instalments. Since the time for payment in terms of the directions issued in the judgment dated 20-05-2025 in W.P(C) No.11248 of 2025 has not yet expired, I am of the view that the remedy of the petitioner is to seek an extension of time by filing a suitable application in the said writ petition, and that the petitioner cannot maintain a separate writ petition.
Accordingly, reserving the right of the petitioner to seek an extension of time to comply with the conditions imposed in the judgment dated 20-05-2025 in W.P(C) No.11248 of 2025, this writ petition will stand dismissed.
