IN THE HIGH COURT OF KERALA AT ERNAKULAM
GOPINATH P., J
ANANTHAPURAM CO-OPERATIVE SOCIETY LTD. NO. T-184 – Appellant
Versus
KERALA COOPERATIVE ARBITRATION COURT – Respondent
JUDGMENT
This writ petition has been filed challenging Exhibit P6 order of the Co-operative Arbitration Court, Thiruvananthapuram setting aside Exhibit P1 order of suspension issued by the petitioner-Society in respect of the 2nd respondent.
2. The learned counsel appearing for the 2nd respondent submits that the reliefs sought for in the writ petition have become infructuous as following disciplinary proceedings, the 2nd respondent has already been dismissed from service and those proceedings have been challenged separately by the 2nd respondent.
3. Having heard the learned counsel appearing for the petitioners and learned counsel appearing for the 2nd respondent, I am of the opinion that since the 2nd respondent has already been dismissed from service, the question of validity of her suspension and the direction to reinstate her in service by setting aside the order of suspension need not be gone into by this Court in this writ petition. The writ petition is therefore dismissed as infructuous.
