IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
SUMESH K.S – Appellant
Versus
SECRETARY, REGIONAL TRANSPORT AUTHORITY, KANNUR – Respondent
JUDGMENT
The writ petition is filed with the following prayers:
“i) To issue a writ of mandamus or any other appropriate writ, direction or order directing the respondent to issue the Regular Permit already granted to the petitioner as per Ext.P1 immediately, on the route Kombanpara- Kannur-Kolithattu in respect of Stage Carriage KL-58/E 5654 with the proposed set of timings without prejudice to the right of the respondent to settle the timing objections if any, thereafter in the interest of justice;
ii)To issue any other appropriate writ, direction or order which this Hon’ble Court deem fit in the circumstances of the case.
iii)To dispense with the filing of translation of vernacular documents.”
2. The learned Government Pleader, on instructions, submits that the permit could not be issued after the settlement of timings only because the officer concerned was on leave.
3. Accordingly, there will be a direction to the respondent/competent authority to consider the issuance of a permit after settlement of timings in accordance with law, within two months from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
