The present contempt petition has been filed alleging non compliance with the Judgment dated 03.03.2025 passed in O.P.(CAT) No.200 of 2023 whereby this Court had disposed of the original petition with the following directions.
“ We thus, dispose of the petition by modifying the order under challenge, noticing the fact that the ratio has been reduced and the chances of inter divisional transfer have increased. The respondents will take a call on the matter when the training is over, considering the request of all the petitioners as well as similarly situated Assistant Loco Pilots or Senior Assistant Loco Pilots working in various divisions for Inter-divisional Transfer, as expeditiously as possible.”
2. The respondents have produced a memo along with order dated 16.02.2026 complying with the order of this Court as well as taking decision as under; “ In view of the above factual position, the following decision is hereby taken;
a. That relief shall be granted to IDT applicants upon availability of replacement manpower.
b. That the replacement manpower is now materializing through the allotment of 64 RRB Pro-ALP papers to Palakkad Division, and PCEE has approved the transfer of staff on IDT to TVC Division.
c. That all four petitioners, namely Vishnu B.S., Anil Raj, Renju Krishnan R., and Rahul Krishnan, who are in possession of valid NOC for IDT to TVC Division, shall be relieved positively for Inter-Divisional Transfer.
d. That the relieve of all employees who are in possession of valid NOC and are willing for IDT transfer, including the petitioners, will be positively considered on Joining of the RRB candidates to working post on completion of their training in all respects, who have been allotted to PGT Division.”
3. We have perused the order impugned as well as the order passed in compliance thereof and find that only the respondents were asked to take a call on the matter when the training is over. Consider the request of all the petitioners as well as similarly situated Assistant Loco Pilots or Senior Assistant Loco Pilots working in various divisions for inter-
divisional transfer, as expeditiously as possible. From the decision taken by the respondents, it is seen that the petitioners are eligible for inter-divisional transfer, and they shall be relieved positively as and when manpower is available.
In view of the aforesaid, nothing survives for further adjudication in this contempt petition. The memo dated 24.02.2026 is taken on record. Accordingly, the contempt of court case is closed.
