Review petitions must demonstrate apparent errors in judgment; procedural compliance is essential for fund disbursement.

We have heard Mr. P. Vijayakumar, learned counsel for the review petitioner and Ms. B. Vinitha, learned Senior Government Pleader.

WP(C) No.33092 of 2014 was filed challenging Ext.P6 order of the Kerala Lok Ayukta dismissing the petitioner’s claim for full amount of DCRG of Rs.41,663/- with interest from 01.10.1993, interest on delayed payment of earned leave surrender from 01.10.1993 to 21.11.2009, and interest on arrears of pay and allowance for the period from 27.09.1993 to 21.11.2009. This Court found that there was no error or illegality in the order of the Lok Ayukta and dismissed the writ petition by judgment dated 11.04.2023. This review petition is filed under Order XLVII Rule 1 read with Section 114 of the Code of Civil Procedure seeking review of the said judgment.

3. We do not see any error of law or facts apparent on the face of record or any other sufficient reasons to interfere with the judgment impugned.

4. When the matter came up for consideration on 30.05.2024, this Court directed the learned Senior Government Pleader to get instructions as to why the admitted portion of DCRG was not disbursed to the petitioner and to ensure its release without any delay, at any rate, within two months. On 19.02.2026, this Court requested the learned Senior Government Pleader to obtain necessary instructions with regard to payment of admissible dues.

Today, the learned Senior Government Pleader handed over a copy of the letter No.PB1/23133/2024/DGE dated 26.02.2026 issued by the Director General of Education stating that the Liability Certificate in respect of the petitioner had been forwarded to the Sub Treasury, Thripunithura as per letter No.P2/25116/2009/DPI dated 23.03.2011 and the Sub Treasury Officer had informed that the DCRG due to the petitioner was not disbursed due to non submission of DCRG payment order before the Treasury by the petitioner. It is further stated that the DCRG would be released after deducting the liability of ₹17,838/- on obtaining necessary revalidation from the Treasury, and that this had been communicated to the petitioner by letter No.P2/28432/2012/DPI dated 10.03.2014. It is submitted by the learned Senior Government Pleader that, for the purpose of revalidation, the petitioner will have to submit necessary application before the Sub Treasury Officer, Tripunithura.

6. The petitioner shall file appropriate application before the Sub Treasury Officer, Thripunithura within one week from today. On receipt of such application, the Sub Treasury Officer, Thripunithura shall disburse the admissible DCRG referred to in the letter dated 26.02.2026 within one week thereafter.

The review petition is disposed of.
