Property conversion fees are invalid when the property is below threshold limits.

Headnote:This writ petition is filed to quash Ext.P8 that demands a fee for property conversion and to mandate a category change of the petitioner's property. Upon measuring the property, the court found the extent as 18.85 cents, thus no fee is needed. The petition is disposed of by setting aside Ext.P8 and directing the second respondent to process the application without any conversion fee.

Result: Ext.P8 is set aside, and the second respondent is instructed to proceed accordingly.

JUDGMENT

This writ petition is filed with following prayers:

i. Call for the entire records leading to Ext.P8 and quash the same to the extent to which it levied fees for conversion of property of the petitioner by the issuance of a Writ of certiorari or any other appropriate Writ, order or direction;

ii. Issue a Writ of Mandamus or any other appropriate Writ, order or direction directing the 1st respondent to change the category of property of the petitioner from ‘nilam’ having extent 07.73 Ares of property (19.100 cents) without payment of fees, within a time frame to be fixed by this Hon’ble Court;

iii. to dispense with the English translation of the documents produced in the vernacular language;

iv. iPass such other orders, interlocutory or otherwise, which are deemed fit and proper in the interest of justice including costs;

2. Petitioner is aggrieved by Ext.P8 to the extent to which it demands fee for conversion of property of the petitioner. When this writ petition came up for consideration on 08.01.2026, this Court directed the additional 4th respondent to measure the property of the petitioner as far as the extent of the property in his possession, and to submit a report. Now a report is submitted by the Taluk Surveyor, Vaikom, which is extracted hereunder:

3. From the above it is clear that the property owned by the petitioner is only 18.85 cents. If that is the case, the petitioner need not pay any conversion fee. In the light of the same, this writ petition can be disposed of.

Therefore, this Writ Petition is disposed of in the following manner:

1. Ext.P8 is set aside.

2. The 2nd respondent/Authorised O to process the Form-6 application in accordance with law, without insisting any conversion fee, as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a copy of this judgment.
