IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
OMANA – Appellant
Versus
THE ASSISTANT ENGINEER, KERALA STATE ELECTRICITY BOARD – Respondent
J U D G M E N T
The petitioner challenges the order passed by the Additional District Magistrate dated 14.02.2025 directing the drawing of an electric line to give supply to the 4th respondent.
2. The petitioner had clearly pointed out to the Additional District Magistrate, which is reiterated in this writ petition, that she had no objection to providing an electricity connection to the 4th respondent by erecting an electric post on the southern boundary of the petitioner's property. Though this is stated in Ext.P2, there is no consideration of the same in the impugned order, nor any reason given as to why the said proposal cannot be accepted.
3. Under such circumstances, I am inclined to quash Ext.P2 with a direction to the 3rd respondent to reconsider the dispute with notice to the petitioner and the 4th respondent and also taking note of the concession above made. Fresh orders shall be passed within six weeks from the date of receipt of a copy of this judgment.
The writ petition is allowed as above.
