JUDGMENT
The only prayer in this original petition is to permit the petitioner to pay off the amounts due in 20 equated monthly instalments. It is stated that the petitioner has already undergone a liver transplant surgery and it is difficult to find money to pay off the amounts in bulk. The respondent appeared through counsel and submitted that as on 05.02.2026, more than Rs.9 lakhs is due.
In the above circumstances, this original petition is disposed of directing the petitioner to pay off the amount due along with interest accrued in 20 equal monthly instalments, the first instalment becoming due on or before 24.03.2026 and the remaining instalments becoming due on or before the 24th day of the succeeding months. If the petitioner makes two consecutive defaults in payment of the instalments, the respondent is free to proceed with recovery steps. Coercive steps for recovery shall be kept in abeyance for facilitating the payments by instalments as directed above.
