VANJA P.T – Appellant
Versus
KERALA BANK – Respondent

For the Respondents: SRI. GILBERT GEORGE CORREYA, SC

JUDGMENT

(Dated this the 27th day of February, 2026)

The petitioner wishes to approach the Debts Recovery Tribunal (DRT) to challenge the proceedings initiated against him under Section 13(4) of the SARFAESI Act . He has already applied for certified copies of the documents produced along with the application under Section 14 and has received the same. The petitioner seeks breathing time to approach the DRT to avail the remedy under Section 17 of the Act. As per Ext.P1, possession of the secured asset is to be taken on

28.02.2026 (tomorrow).

In such circumstances, I deem it appropriate to dispose of this writ petition directing the respondent not to take physical possession for a period of ten days from today to enable the petitioner to avail the said remedy.
