ORDER
This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short, BNSS )
seeking regular bail.
2. The applicants are the accused Nos.1 and 2 in Crime No.814/2025 of Melparamba Police Station, Kasaragod District. The offences alleged are punishable under Sections 6 4(2) (m), 65(1)(m), 137(2), 143(4) and 308(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 6 (1) read with 5(l), 8 read with 7, 12 read with 11(iv), (v) and 15 of the Protection of Children from Sexual Offences Act , 2012 and Sections 6 7A and 67B of the Information Technology Act , 2000.
3. The prosecution case, in short, is that the applicant No.1 got acquainted with the victim girl aged 13 years through instagram during 2019-2020, followed her through mobile phone, possessed her nude photos and videos, committed penetrative sexual assault on her from a nearby stream and in her house after abducting her from the lawful guardianship of her parents. Further, during the period 2022-2023, while the victim was studying in plus one course, by threatening her that he would publish her nude photos and videos, he possessed her gold ornaments worth ₹2,40,000/-
