JUDGMENT
The petitioner is the owner of a stage carriage bearing registration No.KL-42/8396 and by Ext.P1, he applied for temporary permit in the defaulted vacancy of stage carriage No.KL-17/B-9292 on the route Padoor – Vadakkenchery - Perungottukurussi, via Manappadam. The petitioner states that on account of non-operation of regular service, grant of temporary permit under Section 87 (1)(c) of the Motor vehicles Act, 1988 is beneficial for the travelling public. However, the respondent has not so far considered Ext.P1. Accordingly, this Writ Petition is filed for the following relief:-
“ i) Issue a writ of mandamus or other appropriate writ, order or direction to the respondent to consider Ext.P1 application for temporary permit in respect of stage carriage bearing No.KL 42/8396 on the route Padoor – Vadakkencherry in the vacancy of the stage carriage No.KL 17/B 9292 and grant and issue the same as sought by the petitioner.” [sic]
