The parties have settled their disputes in mediation.

They have entered into a memorandum of agreement incorporating the terms of settlement. This appeal is disposed of in terms of the settlement. The memorandum of agreement will form part of this judgment.

2. The matter is remitted back to the Execution Court for passing further orders in terms of the Settlement. 3. It is brought to the notice of this Court that, there is no regular sitting in the Execution Court at present. If that be so, the court holding charge of the said Court, shall take up the matter and pass appropriate orders within two weeks from the date of receipt of a copy of this judgment.
