JUDGMENT

The above writ petition is filed seeking the following reliefs:

“(i) Issue a writ of mandamus or any other appropriate writ, order or direction commanding respondents 2 to 4 not to shift or establish the auto rickshaw stand in front of the petitioner’s building bearing Nos. 49/1400 and 49/1401 situated near Thana Junction, Kannur;

(ii) Issue a writ of mandamus directing respondents 2 to 4 to consider and pass appropriate orders on Exhibit P4 representation submitted by the petitioner, after affording an opportunity of hearing to the petitioner, within a time frame to be fixed by this Hon’ble Court;

(iii) Issue a writ of mandamus directing respondents 2 to 4 not to implement any proposal for shifting the existing auto stand from Anayidukku Road to the frontage of the petitioner’s building;

(iv) Grant such other and further reliefs as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.”

2. According to the petitioner, there is a proposal from the side of the Corporation to shift an auto stand which will completely block the access to the petitioner’s building. According to the petitioner, the auto stand is now situated at Anayidukku Road. The petitioner submitted Ext.P4 representation before the 4th respondent. The same is not considered is the grievance of the petitioner. Hence, this writ petition is filed.

3. Heard, the learned counsel appearing for the petitioner and the Standing Counsel appearing for the Corporation. I also heard the learned Government Pleader.

4. After hearing both sides, I think, this writ petition need not be retained here. There can be a direction to the 4th respondent to consider Ext.P4 representation with notice to the petitioner and other affected parties, if any.

Therefore, this Writ Petition is disposed of with the following directions:

1. The 4th respondent is directed to consider and pass appropriate orders in Ext.P4, after giving an opportunity of hearing to the petitioner and other affected parties, if any, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a certified copy of this judgment.

2. Till decision is taken as directed above, the status quo regarding the auto stand will continue.
