This is a petition filed by the sole accused in CC. No.194 of 2023 on the file of Chief Judicial Magistrate, Kollam arising out of Crime No.20 of 2023 of Railway Police Station, Kollam. He filed this Crl.M.C under Section 482 Cr.PC praying for quashing all further proceedings against him. The offence alleged against the petitioner is under Section 354 IPC .
2. The prosecution case is that, on 11.02.2023 at about
4.15 p.m., when the de facto complainant was working as a TTE in Thiruvananthapuram Chennai Central Mail, asked the identity proof of the accused, who was a passenger in the said train, he abused her and outraged her modesty.
3. According to the learned counsel for the petitioner, even if the entire allegations levelled against the petitioner, as such is believed, the same will not amount to offence punishable under Section 354 of IPC . Therefore, he prayed for quashing all further proceedings against the petitioner
