The court establishes the right to a customized Police Clearance Certificate for employment purposes amidst pending legal issues.

JUDGMENT Dated this the 3^rd day of March, 2026 The petitioner, who is an employee of the Kerala State Road Transport Corporation, has approached this Court seeking the following reliefs:

(a) Issue a writ of mandamus or other appropriate writ, order or direction commanding the respondents not to insist upon a Police Clearance Certificate for processing the petitioner’s claim for service benefits including grade promotion and other consequential benefits.

(b) Issue a writ of mandamus or other appropriate writ, order or direction directing the 2^nd respondent to consider and pass appropriate orders in Ext.P7 representation forwarded to the 2^nd respondent, after giving an opportunity of personal hearing to the petitioner.

(c) Direct the respondents to grant the petitioner the eligible grade promotion and consequential service benefits, together with all consequential monetary benefits.

2. It is evident from the pleadings and arguments that the petitioner is involved in a criminal offence under Sections 336 and 324 of the IPC in CC No.54/2014 before the Judicial First Class Magistrate’s Court-II, Punalur.

Considering the fact that the Police Clearance Certificate is required to the petitioner for employment purpose, I am of the view that respondents 3 and 4 can be directed to consider the application of the petitioner and issue a customised Police Clearance Certificate indicating the offences in which the petitioner is / was involved.

The writ petition is accordingly disposed of directing respondents 3 and 4 to issue customised Police Clearance Certificate to the petitioner. This shall be done within a period of two weeks. On receipt of the customised Police Clearance Certificate, respondents 1 and 2 shall consider and pass orders on Ext.P7 representation within a further period of one month.
