2026 Supreme(Online)(Ker) 19139

IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
THRESSIAMMA VARKY, VARKEY – Appellant
Versus
VELLOOR SERVICE CO-OPERATIVE BANK – Respondent
WP(C) NO. 9169 OF 2026

Advocates:
For the Appellants/Petitioners: SRI. V. VISAL AJAYAN, SRI. FRANCIS THENAMPARAMBIL
For the Respondents: SMT. RESMI THOMAS, GOVERNMENT PLEADER

Injunction orders must be passed after hearing all affected parties to ensure fairness in legal proceedings.

Headnote:This judgment concerns an appeal against an injunction order (Ext.P2) passed without hearing the petitioners. The court notes the procedural impropriety and orders the 2nd respondent to hear the petitioners on Ext.P3 within three weeks. The status quo is to be maintained in the interim.

Result: 'Writ petition is disposed of, directing the 2nd respondent to pass orders...' (Paragraph 1).

JUDGMENT

The petitioners challenge Ext.P2 injunction order passed by the 2nd respondent, against which the petitioners have preferred Ext.P3 application. The petitioners submit that Ext.P2 was passed without hearing the petitioners.

Taking note of the fact that Ext.P2 was passed without hearing the petitioners and they have already moved Ext.P3 to re-hear the injunction application, the Writ petition is disposed of, directing the 2nd respondent to pass orders on Ext.P3, after hearing the affected parties within three weeks from the date of receipt of a copy of this judgment. The status quo as of date shall be maintained till orders are passed as directed above.
