The court affirmed that a petition may be reviewed when its underlying orders remain operational and not infructuous.

Headnote:The review petition was allowed based on the argument that the writ petition had not become infructuous and the orders were still operational. The court determined that the matter warranted restoration, emphasizing the necessity to address the petitioner's claims as the appellate processes were still viable. The final decision restored the writ petition.

O R D E R

Dated this the 13th day of March, 2026 A submission was made in the Court that the writ petition has become infructuous. Accordingly, the writ petition was dismissed as infructuous on 26.08.2025.

2. The petitioner in the writ petition filed W.A.No.2141 of 2025 contending that the writ petition has not become infructuous and the petitioner deems it appropriate to prosecute the challenge against the order impugned in the writ petition. A Division Bench of this Court closed the Writ Appeal permitting the writ petitioner to approach the Single Judge.

Hence, the petitioner is before this Court in review.

3. It is admitted on either side that the matter has not become infructuous and the orders challenged by the petitioner in the writ petition are still operating.

In view of the above, the review petition is allowed.

W.P.(C) No.30806 of 2025 is restored to file.
