THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 24.03.2026, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
JUDGMENT Ext.P2 is an application preferred by the petitioner seeking transfer of registry. The same is pending before the 4th respondent/Village Officer. The petitioner seeks expeditious disposal of the same.
2. Learned Government Pleader would submit that Ext.P2 ought to have been filed before the 3rd respondent/Tahsildar. Besides a defect with respect to Ext.P3 Encumbrance Certificate is also pointed out. It was submitted that the requisite period is not covered by Ext.P3 Encumbrance Certificate.
3. In the circumstances, the 4th respondent/Village Officer will stand directed to forward Ext.P2 to the 3rd respondent/Tahsildar within a period of 10 days from today. The learned Government Pleader will give necessary instructions in this regard to the 4th respondent, forthwith. Once Ext.P2 is received, the 3rd respondent/Tahsildar will consider the same in accordance with law, expeditiously, at any rate, within a period of three months from the date of receipt of Ext.P2.
4. Needless to say that the petitioner shall produce a fresh Encumbrance Certificate as required by law before the
3rd respondent.
5. Once transfer of registry is allowed, the 4th respondent will accept necessary land tax from the petitioner in respect of the subject property, without any further delay.
This Writ Petition will stand disposed of as above.
