This is a petition filed under Section 528 of B.N.S.S. , by the accused in Crime No.9 of 2021 of Cyber Crime Police Station, Thiruvananthapuram, which is pending as CC. No.380 of 2023 on the file of Additional Chief Judicial Magistrate Court, Thiruvananthapuram. The offences alleged against the petitioner is under Section 354D of IPC and Section 67 of IT Act.
2. The prosecution case is that the accused, with an intention to insult the modesty of the de facto complainant, sent obscene messages and videos to the Instagram account of the de facto complainant and thereby, he is alleged to have committed the aforesaid offences.
3. According to the petitioner, the dispute has been amicably settled with the defacto complainant/victim/ respondent No.2 and that she agreed to drop all further proceedings relating to the above dispute. Therefore, the petitioner prayed for quashing all fur
