For the Appellants/Petitioners: SMT.MINIMOL K.M.

Determines that cases may become moot if the order sought is no longer achievable over time.
Headnote:The Criminal Miscellaneous Case filed to recall an arrest warrant issued against the petitioners was dismissed as infructuous, with a reserve of the petitioners' rights to address any further grievances. The case emphasizes the principle of purposefulness in legal proceedings, indicating that cases may become moot over time, particularly when relief sought becomes unachievable.
O R D E R
The Criminal Miscellaneous Case is filed to direct the Court of the Additional Chief Judicial Magistrate (For the trial of criminal cases against sitting and former MPs/MLAs of the State), Ernakulam, to recall the warrant of arrest that has been issued against the petitioners in S.T.No.116 of 2022. 2. Although the Crl.M.C. was filed on 20.12.2025, the petitioners have not produced the physical copy, this Court has not admitted the case and no interim order has been passed.
At this distance of time, I am of the view that the Crl.M.C.
has outlived its purpose. Resultantly, the Crl.M.C. is dismissed as infructuous, but by reserving the right of the petitioners to workout his remedies, if there is any subsisting grievance.
