WP(C) NO. 9301 OF 2026
For the Appellants/Petitioners: DR.GEORGE ABRAHAM, SMT.MARY CATHERINE PRIYANKA, P.S., SHRI.ALEX TOM JOSEPH
For the Respondents: GP HARITHA V A
The court emphasized the importance of timely decision-making by the government on employment-related grievances.
Headnote:The petitioner was appointed in a permanent vacancy in a school based on previous orders. The grievance revolves around the approval of their payment terms for a specific period. The High Court directed the government to review the petitioner's revision and reach a decision within three months.
JUDGMENT
Dated this the 26th day of March, 2026 Petitioner is appointed in the permanent vacancy on
30.11.2009 as per Ext.P1. The said appointment was approved as per Ext.P2 with effect from 01.06.2010 onwards and period from 30.11.2009 to 31.03.2010 was approved on daily wages basis. The petitioner has a grievance regarding approving the said period only on daily wages and submits that the said stand taken by the Department is contrary to the direction issued by the Apex Court in State of Kerala and Others v. Sneha Cherian & Another [2013 (1) KHC 660], wherein the Court has directed that the Manager can make appointment in the school even if the duration of which is less than one academic year, but on daily wage basis and if the duration of vacancy exceeds one academic year that can be filled up on scale of pay basis. Based on the same petitioner submitted that the period from 30.11.2009 to 31.03.2010 ought to have been approved on a scale of pay. Petitioner submits that a senior of the petitioner in the very same school has been granted the said benefit as per Ext.P4. Aggrieved by the same, petitioner has preferred Ext.P6 revision petition before the 1st respondent Government and seeks for an expeditious disposal of the same.
2. Heard the learned Government Pleader also.
After hearing boths sides, I am inclined to dispose of the writ petition with a direction to the 1st respondent Government to consider and pass orders on Ext.P6 after affording an opportunity of being heard to the petitioner and the 5th respondent Manager, and take a decision in this regard within an outer limit of three months from the date of receipt of a copy of this judgment.
