COMMON JUDGMENT
The petitioners are the complainant and victims in FIR Nos.586/2025 of Edakkara Police Station and FIR No.700/2025 of Thiruvambady Police Station.
2. Some similarly situated persons approached this Court and filed W.P(Crl) No.985/2025 seeking constitution of a Special Investigation Team (SIT). As per judgment dated 18.08.2025, this Court disposed of W.P(Crl) No.985/2025 with the following directions:
“1. The 3rd respondent will take necessary steps to constitute a special investigation team to investigate all the cases of the aggrieved depositors within one month from the date of receipt of a copy of this judgment.
2. The new investigating authority will proceed with the investigation in accordance with law and try to complete the investigation as expeditiously as possible.
3. Respondent Nos.9 and 10 will look into Exts.P13 and P14 and do the needful in accordance with law and communicate the action taken in Exts.P13 and P14 to the petitioners within two months from the date of receipt of a copy of this judgment.”
3. Pursuant to the direction in the judgment dated 18.08.2025, the State Police Chief has directed the constitution of an SIT. It is submitted that 19 cases have already been transferred to SIT.
4. When the Writ Petitions were taken up for hearing on 18.02.2026, the learned Senior Public Prosecutor submitted that the Government have taken steps to transfer the cases to the SIT. Admittedly, FIR Nos.586/2025 of Edakkara Police Station and FIR No.700/2025 of Thiruvambady Police Station also relate to the cases now transferred to the SIT. The allegations of the petitioners relate to misappropriation of the deposits made by various persons in the NM Nedumparambil Nidhi Limited.
5. Having regard to the fact that the similar cases have been transferred to the SIT, there will be a direction to respondent No.2 to transfer FIR Nos.586/2025 of Edakkara Police Station and FIR No.700/2025 of Thiruvambady Police Station to the Special Investigation Team. The Investigating agency will complete the investigation as expeditiously as possible.
The Writ Petition is disposed of as above.
