JUDGMENT

The petitioner is a contractor who was entrusted with the work of providing additional facilities for the material collection center as per the agreement dated 07.02.2023. The petitioner had already completed 60% of the work, and according to the petitioner, as of now, the petitioner is entitled to get an amount of Rs.9,00,000/- towards the part bills. Since the amount has not been disbursed in full, the petitioner has approached this Court seeking a direction to release the said amount.

2. A statement has been submitted on behalf of the 1st and

2nd respondents, wherein, it is stated that, as per the records maintained by the respondents, the amount for the work so far executed by the petitioner, would come to only Rs.5,16,979/- inclusive of GST. As far as the other amounts are concerned, the same can be considered only after measuring the work and after certifying the same. Since the relief sought by the petitioner in this writ petition is to direct the respondent to pay the admitted amount and since in the counter affidavit respondents have admitted Rs.5,16,979/- as the amount payable to the petitioner, this writ petition can be disposed of by fixing a timeline for the release of the same.

Accordingly, this writ petition is disposed of, directing the 1st and 2nd respondents to ensure the amount of Rs.5,16,979/- be released to the petitioner within a period of one month from the date of receipt of a copy of this judgment. This shall be without prejudice to the right of the petitioner to invoke the appropriate remedies in case the remaining amount is not paid.
