Court ordered that proceedings shall not be disrupted while reviewing pending applications in execution petitions.

JUDGMENT

The prayer in this Original Petition is for a direction to the Sub Court, North Paravur to dispose of Ext.P11 application, E.A. No.1 of 2026 in E.P. No.139 of 2015 in O.S. No.171 of 2009. There is also a prayer to withhold passing any orders, recording satisfaction, settlement, adjustment or dismissal of E.P. No.139 of 2015 before consideration of E.A.

No.1 of 2026.

2. The respondents appeared through counsel.

The respondents have no objection regarding consideration of Ext.P11 E.A.

In the above circumstances, the Original Petition is allowed. There will be a direction to the Sub Court, North Paravur to hear and dispose of E.A. No.1 of 2026 in E.P. No.139 of 2015 in O.S. No.171 of 2009 before passing any orders, recording satisfaction of decree or any settlement.

The parties are free to seek advancement of proceedings to an early date before the vacation and if such an application is filed, the same shall be considered favourably.
