1. compensation refixing consideration (Para 1)
2. delay in review petition (Para 2)
3. request for condonation of delay (Para 3)
ORDER Soumen Sen, C.J.
The grievance of the petitioners in the review petition is that while reducing and refixing the compensation to Rs.1,25,000/- with 12% interest, the co-ordinate Bench had failed to take into consideration the fact that a sum of Rs.1,750/- has already been granted to the petitioners under Part I by the Motor Accident Claims Tribunal.
2. Although the review petition was filed with a prayer for condonation of delay of 42 days on 2nd March 2000, this matter has been kept pending and no attempt was made to file the said application either during the period of limitation or to move it thereafter when the Bench was available.
3. In any event, having regard to the fact that at this distant future, the prayer for condonation of delay cannot be allowed, as the petitioner has failed to take timely steps to move the application for review.
Accordingly, the petition for condonation of delay is dismissed as time-barred, and the review petition also stands dismissed.
