J U D G M E N T

The petitioner is the holder of Ext.P1 regular permit on the route Mariyapuram - Ayyanthole in respect of the stage carriage bearing registration No.KL 13 M 4001. The petitioner submitted an application for renewal of Ext.P1. During the pendency of the said application, the petitioner applied for replacement of the vehicle with vehicle bearing registration No.KL 04 T 6852. Since there was a delay in considering the application for replacement, he approached this Court by filing W.P.(C) No.19996 of 2025. This Court, by Ext.P2 judgment disposed of the said writ petition directing the 1st respondent to consider the application of the petitioner for renewal of permit dated 21.03.2021 in the next board meeting and the application for replacement dated 22.02.2025 within one month from the date of passing orders on the application for renewal.

After Ext.P2 judgment and during the pendency of the above applications, the petitioner submitted Ext.P3 request before the 2nd respondent to substitute the vehicle bearing registration No. KL 04 T 6852 with later model vehicle bearing registration No. KL 05 X 6577 and to consider the application for renewal and replacement by accepting the current records of the vehicle bearing registration No. KL 05 X 6577. The 2nd respondent issued Ext.P6 communication, stating that, since as per Ext.P2 judgment, this Court directed replacement of No.KL 13 M 4001 with vehicle No. KL 04 T 6852, Ext.P3 request cannot be considered. Accordingly, the petitioner has filed this writ petition for a direction to the respondents to consider the application for renewal of permit on the route Mariyapuram – Ayyanthole in respect of the later model vehicle bearing registration No. KL 05 X 6577.

3. Heard the learned counsel for the petitioner and the learned Government Pleader.

In the facts and circumstances of the case, there will be a direction to the 1st respondent to consider the application for replacement as mentioned in Ext.P2 judgment in the light of Ext.P3 request of the petitioner, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a copy of this judgment.

The writ petition is disposed of.
