JUDGMENT
Devan Ramachandran, J When this matter was called today, Sri.T.Sanjay - the learned counsel for the 1st respondent, submitted that this appeal, or even the judgment impugned, may have become unnecessary for the singular reason that his client has resigned from service giving up all further claims.
2. Sri.Daya Sindhu Sreehari, learned Central Government Counsel, submitted that, even if the afore is true, the declarations in the judgment might create impediments in future.
3. However, since the submission of Sri.T.Sanjay is as afore, we are of the view that nothing remains in this case for us to consider on merits, nor for the judgment to remain.
In the afore circumstances, we allow this appeal and set aside the judgment; however, clarifying that we have not entered into the merits of any of the rival contentions or the issues projected; and all of them are left open.
